﷽   All the praise is for Allah who is the author of all existence and the most generous to his creation while he is also the all compelling, he is the only one worthy of our worship having no partners no associates no sons no daughters no one whom he must consult and no one or anything which has any comparison with him all the praise is for Allah who is the king of all who claim sovereignty the only one who has the right to legislate for his creatures he is the giver of life he is the cause of death while death has no effect upon him because he is the ever living the self subsisting the eternal and the only absolute all the praises for Allah who has power over all things and there is in reality no power and no strength no influence to cause benefit or detriment except through him it is he who created this complex world the scene and the unseen the evident and the speculative the earth and all that is on it and everything that is in it   is he who sent his messengers and...

Shari,ah (Islamic Law)


Islamic Shari'ah the word Shari'ah means a method. In Islamic terminology, Shari'ah means the legal system or Islamic Shari'ah refers to the religious and worldly affairs of human beings that Allah (God) has established for mankind to guide them. The right path is a path that leads them to happiness in this world and in the Hereafter. All the Messengers taught the same message that worship only one Allah, but the specific prescriptions of these divine laws differ according to the needs of people and times. Prophet Muhammad was the last messenger and his law represents the ultimate manifestation of divine mercy, which is the concept of law according to the Qur'an:

حُرِّمَتْ عَلَيْكُمُ ٱلْمَيْتَةُ وَٱلدَّمُ وَلَحْمُ ٱلْخِنزِيرِ وَمَآ أُهِلَّ لِغَيْرِ ٱللَّهِ بِهِۦ وَٱلْمُنْخَنِقَةُ وَٱلْمَوْقُوذَةُ وَٱلْمُتَرَدِّيَةُ وَٱلنَّطِيحَةُ وَمَآ أَكَلَ ٱلسَّبُعُ إِلَّا مَا ذَكَّيْتُمْ وَمَا ذُبِحَ عَلَى ٱلنُّصُبِ وَأَن تَسْتَقْسِمُوا۟ بِٱلْأَزْلَـٰمِ ۚ ذَٰلِكُمْ فِسْقٌ ۗ ٱلْيَوْمَ يَئِسَ ٱلَّذِينَ كَفَرُوا۟ مِن دِينِكُمْ فَلَا تَخْشَوْهُمْ وَٱخْشَوْنِ ۚ ٱلْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِى وَرَضِيتُ لَكُمُ ٱلْإِسْلَـٰمَ دِينًۭا ۚ فَمَنِ ٱضْطُرَّ فِى مَخْمَصَةٍ غَيْرَ مُتَجَانِفٍۢ لِّإِثْمٍۢ ۙ فَإِنَّ ٱللَّهَ غَفُورٌۭ رَّحِيمٌۭ 

Forbidden to you are carrion, blood, and swine; what is slaughtered in the name of any other than Allah; what is killed by strangling, beating, a fall, or by being gored to death; what is partly eaten by a predator unless you slaughter it; and what is sacrificed on altars. You are also forbidden to draw lots for decisions.1 This is all evil. Today the disbelievers have given up all hope of ˹undermining˺ your faith. So do not fear them; fear Me! Today I have perfected your faith for you, completed My favour upon you, and chosen Islam as your way. But whoever is compelled by extreme hunger—not intending to sin—then surely Allah is All-Forgiving, Most Merciful. Quran (chapter 5 verse 3)

 

وَكَتَبْنَا عَلَيْهِمْ فِيهَآ أَنَّ ٱلنَّفْسَ بِٱلنَّفْسِ وَٱلْعَيْنَ بِٱلْعَيْنِ وَٱلْأَنفَ بِٱلْأَنفِ وَٱلْأُذُنَ بِٱلْأُذُنِ وَٱلسِّنَّ بِٱلسِّنِّ وَٱلْجُرُوحَ قِصَاصٌۭ ۚ فَمَن تَصَدَّقَ بِهِۦ فَهُوَ كَفَّارَةٌۭ لَّهُۥ ۚ وَمَن لَّمْ يَحْكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُو۟لَـٰٓئِكَ هُمُ ٱلظَّـٰلِمُونَ

We ordained for them in the Torah, “A life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth—and for wounds equal retaliation.” But whoever waives it charitably, it will be atonement for them. And those who do not judge by what Allah has revealed are ˹truly˺ the wrongdoers. Quran (Chapter 5 verse 45)

 

وَأَنِ ٱحْكُم بَيْنَهُم بِمَآ أَنزَلَ ٱللَّهُ وَلَا تَتَّبِعْ أَهْوَآءَهُمْ وَٱحْذَرْهُمْ أَن يَفْتِنُوكَ عَنۢ بَعْضِ مَآ أَنزَلَ ٱللَّهُ إِلَيْكَ ۖ فَإِن تَوَلَّوْا۟ فَٱعْلَمْ أَنَّمَا يُرِيدُ ٱللَّهُ أَن يُصِيبَهُم بِبَعْضِ ذُنُوبِهِمْ ۗ وَإِنَّ كَثِيرًۭا مِّنَ ٱلنَّاسِ لَفَـٰسِقُونَ

And judge between them ˹O Prophet˺ by what Allah has revealed, and do not follow their desires. And beware, so they do not lure you away from some of what Allah has revealed to you. If they turn away ˹from Allah’s judgment˺, then know that it is Allah’s Will to repay them for some of their sins, and that many people are indeed rebellious. (Chapter 5 verse 49)

 

أَفَحُكْمَ ٱلْجَـٰهِلِيَّةِ يَبْغُونَ ۚ وَمَنْ أَحْسَنُ مِنَ ٱللَّهِ حُكْمًۭا لِّقَوْمٍۢ يُوقِنُونَ

Is it the judgment of ˹pre-Islamic˺ ignorance they seek? Who could be a better judge than Allah for people of sure faith? (Chapter 5 verse 50)

 

يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ كُتِبَ عَلَيْكُمُ ٱلْقِصَاصُ فِى ٱلْقَتْلَى ۖ ٱلْحُرُّ بِٱلْحُرِّ وَٱلْعَبْدُ بِٱلْعَبْدِ وَٱلْأُنثَىٰ بِٱلْأُنثَىٰ ۚ فَمَنْ عُفِىَ لَهُۥ مِنْ أَخِيهِ شَىْءٌۭ فَٱتِّبَاعٌۢ بِٱلْمَعْرُوفِ وَأَدَآءٌ إِلَيْهِ بِإِحْسَـٰنٍۢ ۗ ذَٰلِكَ تَخْفِيفٌۭ مِّن رَّبِّكُمْ وَرَحْمَةٌۭ ۗ فَمَنِ ٱعْتَدَىٰ بَعْدَ ذَٰلِكَ فَلَهُۥ عَذَابٌ أَلِيمٌۭ

O believers! ˹The law of˺ retaliation is set for you in cases of murder—a free man for a free man, a slave for a slave, and a female for a female.1 But if the offender is pardoned by the victim’s guardian,2 then blood-money should be decided fairly3 and payment should be made courteously. This is a concession and a mercy from your Lord. But whoever transgresses after that will suffer a painful punishment. (Chapter 2 verse 179)

وَلَكُمْ فِى ٱلْقِصَاصِ حَيَوٰةٌۭ يَـٰٓأُو۟لِى ٱلْأَلْبَـٰبِ لَعَلَّكُمْ تَتَّقُونَ

There is ˹security of˺ life for you in ˹the law of˺ retaliation, O people of reason, so that you may become mindful ˹of Allah˺.(Chapter 2 verse 179)

 

Why Sharia is necessary Muslims believe that the purpose of their creation is nothing but servitude, which is to be a servant of the Creator of mankind. They also believe that no one can fulfill this purpose without the guidance of Allah. The mission of servitude is accomplished. The guidance of Allah, which is Shari'ah, Shari'ah is a path prescribed by Allah for those who accept it so that they can achieve success in this world and the hereafter, and within the limits and restrictions of Islamic Shari'ah. The word means one who submits to Allah. Islam expects a Muslim to do so. Shari'ah is not limited to follow its rules in every aspect of life and no aspect of human life is outside its scope whether it is personal and family religious and social moral and political or whether it is related to business and economics. Be as stated in the Qur'an:

وَمَا كَانَ لِمُؤْمِنٍۢ وَلَا مُؤْمِنَةٍ إِذَا قَضَى ٱللَّهُ وَرَسُولُهُۥٓ أَمْرًا أَن يَكُونَ لَهُمُ ٱلْخِيَرَةُ مِنْ أَمْرِهِمْ ۗ وَمَن يَعْصِ ٱللَّهَ وَرَسُولَهُۥ فَقَدْ ضَلَّ ضَلَـٰلًۭا مُّبِينًۭا

It is not for a believing man or woman—when Allah and His Messenger decree a matter—to have any other choice in that matter.1 Indeed, whoever disobeys Allah and His Messenger has clearly gone ˹far˺ astray. Quran (chapter 33 verse 36)

Sources of Islamic Shari'ah consist of Islamic Shari'ah laws and these laws are derived from the following sources: Quran, Book of Allah, Sunnah of the Prophet Muhammad, Approval of Ijma and unanimous opinion of Muslim jurists. Qur'an, Sunnah and Ijmaa - let us take a look at each of them. The Qur'an is the first source of Sharia law. Muslim Laws Allah Almighty revealed the Holy Qur'an to the Prophet Muhammad through Gabriel, peace be upon him. The Qur'an itself is a complete code of life that tells us what Allah Almighty wants us to do from birth to death. The Qur'an is the primary source of Shari'ah because it contains Allah's direct words However, when He does not speak directly on a particular subject, Muslims turn to alternative sources. Examples of the Prophet's actions and his life Sunnah are things that the Muhammad said or agreed to Sunnah clarifying the details of what is generally stated. On the Qur'an, the Prophet followed the command of Allah all his life, it is part of the faith of every Muslim that it is a complete obedience to the Sunnah of Allah and therefore it should be followed, who were the Companions, the family and the family of the Prophet Muhammad. And there were companions Those who observed him in their life and shared with others what they saw in his words and actions, what is hadith, these words are actions and actions done with the approval of the Holy Prophet Muhammad. It includes issues related to personal ethics and community. Family Relations and Political Matters Since the death of the Prophet Muhammad the hadiths were carefully collected and compiled, which the Companions of Ijmaa have described as the third source of Shari'ah. It can be defined as the consensus opinion of the Companions of the Prophet Muhammad Ijma is simply a unanimous decision of all Muslim jurists of the first three centuries used to resolve an issue in Islamic society.
